Responsibility
The client/signatory of this agreement states that he/she is the holder of a valid driving license. He/she will be held solely responsible for the rented vehicle during the entire rental period - regarding infringements, fines, accidents and any other claims or damages sustained. He/she shall also ensure that any other person aged 21 or above called to drive the rented vehicle is the holder of a valid driving license for the appropriate class since a minimum period of one year. Anyone driving the rented vehicle must be able to produce a valid driving license upon request of the local authorities.
Collection and return of your rented vehicle
The duration of the car rental begins as form the precise moment you take delivery of the vehicle up to the date and time you return it, as specified and agreed upon in the contract. The car must be returned at such time and precise place, as agreed upon, in the same condition or state of cleanliness as at taking delivery of it – with fair wear and tear expected and judged tolerable. Also, returning the vehicle at any other location rather than that specified, entails a charge fee of MRU 500.
Fuel
The vehicle is delivered with a full tank and must hence be returned with its tank filled to the same level as at delivery. In case, such fuel level is shown to be less by the fuel indicator, a re-fuelling charge fee of MRU 300 is applicable.
Refunds
No refund will be entertained for:
(1) Late pick-up or early drop-off,
(2) No shows or cancellations made on or after rental start date nor for unfitness or inability to drive by the client, and
(3) Inability to meet eligibility requirements, the only exception applying to a case of ‘Force Majeure’ (client having to cancel stay in Mauritius or go back to home country, for instance – on the understanding that full evidence must be imperatively provided).
Car Fleet
A car fleet with no specific model is always available to facilitate a reasonable degree of choice.
Insurance
Vehicles are covered by a comprehensive insurance policy (including an excess).
Not covered – Damage to tires not attributable to normal wear and tear, rim & accessories, overhead or underbody Damage, damage by water or due to reckless driving or to deliberate intention to cause damage to or by third party.
Such damage(s) remain(s) chargeable to the client (as sole responsible party).
Drug Trafficking & Other Illegal or Criminal Activities
In the event that the vehicle has been taken into the custody of or compounded by the Police as a result of drug trafficking or any other illegal or criminal activity, the insurance cover becomes de facto VOID. This applies to:
• Drink and Drive
• Driving Without License
• Or any other circumstance prohibited by law.
It is incumbent on the client to compensate the owner(s) in TOTO for any charges so incurred or even the full cost of the vehicle, as the case may be. All additional costs or losses incurred up to the time of full recovery of the vehicle remain fully chargeable to the client/signatory of the contract.
Use of the Vehicle
The Rental agreement lapses immediately and automatically in case of use for illegal purpose(s), racing, participation in contests or other performance tests of any kind, towing, carrying excess passengers, driving under alcoholic influence, carrying passengers against payment, transporting goods, carrying inflammable or harmful substances, or effecting unauthorized repairs or modifications.
The Hirer MUST check and maintain the car's engine oils and coolant levels, fill car with only the fuel type specified, keep car locked and the keys in a safe place all the times, comply with all applicable seat belt and child restraint laws.
Emergency/Accident/ Theft
In case of accident, liability must not be endorsed. It is advised to call the police and immediately notify the car rental company for assistance and advice on: +230 57 08 28 78 or +230 261 0870
The client/renter shall act as follows:
• Note down the name(s) – address(es) and other contact details of any person involved.
• Notify within the shortest delay the police and the company.
• Provide a hard copy of his/her driving license and passport / ID card.
• Corporate fully with the rental company – insurance company or other official authorities during investigation.
Non-cooperation or non-collaboration may entail entire responsibility to be solely attributable to the client/renter.
Delivery and Collection of vehicles in Mauritius
Delivery and collection of vehicles may be arranged for throughout the whole island (at the airport, in hotels, private villas/bungalows) or upon special request at any accessible and acceptable point.
Special Arrangements
Child seats, roof racks, GPS and other extras are available upon request and subject to availability.
Mechanical/ Technical Problems
Rented vehicles should not be driven whenever or wherever unworthy road conditions prevail. The rental company usually provides road assistance 24/7 in case of breakdown. However, no client is authorized to undertake repairs or replacement of spare parts without the prior or formal authorisation of the rental company.
Cyclone and Other Unfavorable Weather / Climatic Conditions
Upon issue of a cyclone warning of class 3, the rented vehicle should be placed in a safe place – distance away from trees or other hazards likely to cause damage to it. In the event that the client is unable to adequately secure the vehicle from risks, he/she should immediately notify the rental company for prompt action to be undertaken towards securing the vehicle. Any such cost incurred for securing the vehicle shall be chargeable to the client.
Agreement
The various clauses, terms and conditions laid down in this contract have mutually been agreed upon by both parties (the client on the one hand and the rental company on the other hand).
Miscellaneous
The client/renter is bound to comply with the laws and regulations in force in Mauritius – regarding road traffic regulations and agrees to bear the consequences of non-compliance and take charge of any cost whatsoever resulting from infringement relating to such regulations.
